Tallinn Regional Court Finds Tervise Paradiis and Employee Guilty in Drowning Death

The Tallinn Regional Court overturned the Pärnu District Court's ruling and found the private limited company Tervise Paradiis and its head instructor Gert Kuusik guilty of causing death through negligence. Kuusik was sentenced to a suspended sentence of one year and three months imprisonment.

The Tallinn Regional Court made an unexpected reversal in the criminal case related to the water accident, overturning the Pärnu District Court's earlier ruling in its entirety and finding both the private limited company Tervise Paradiis and its head instructor Gert Kuusik guilty of causing death through negligence.

The Regional Court sentenced Kuusik to a suspended sentence of one year and three months imprisonment. Additionally, the company Tervise Paradiis was found guilty as a legal entity.

The case concerns a drowning death that occurred at Tervise Paradiis water centre, in which the Pärnu District Court had previously acquitted the defendants. The Regional Court's ruling means that the water centre's employee and the company bear responsibility for what happened, as they failed to exercise sufficient care and did not ensure visitor safety.
